Physical Media vs Ripped vs legal
Quote:
When friends bring over a CD, I can use my Oppo 105. Mostly though, they bring vinyl if anything. Surround sound recordings are not my thing (I have about 20 and they are all just weird to listen to), so that nixes that reason. But, to each their own. I know a lot of folks that would never give up their media. I'm thinking of selling mine now that they are all ripped, backed up on site twice and off site. Depending on the size of your collection, you could use that money to buy a top notch DAC! Sort of like my friend who bought a Chevy Volt and what he saves in gas, pays for his monthly lease payment on it. |

Second, under the FAIR USE PROVISION of the Copywright Act, you are entitled rip the CD's and sell them later because the copies you made were lawful at the time of ripping (you owned the CD's). So, you buy a CD, you can rip to your computer since you OWN the CD. You are then entitled to, under section 109 of the Copyright Act (First Sale Doctrine) to RESELL or give away the CD. So.... You can rip a copy of the CD you own and purchased legally to your computer (legal). You can sell a copy of the CD you own and purchased legally. What you DON'T have the right to do is sell or redistribute copies of the music at any time (you don't possess distribution rights). The issue of the files remaining on your computer after you sell the CD's has NOT been addressed because you cannot make it legal to rip the CD's and legal to sell them and then make it illegal in the middle. The law doesn't work that way. That being said, I plan (for now) to keep all my CD's for fear of a crash or failure in my backup system. .....This is definitely off topic....so let's get back to discussing how great both the K-03 and MCD1100 are..... |

Mike.......This would make a great thread on its on merit. Information like this gets buried and lost under unrelated thread titles. Why not repost this as a new thread.

Sorry for going off topic but the industry is doing its best to introduce technology whereby you will never own a physical copy so that there will never be the question of title, only controlled/diminishing playback rights. The newest example of this is Ultraviolet Blu-ray. Once the consumer has been dumbed down further by convenience, there will be no such thing as any form of "title" in the future of digital. Mike.......I find the subject of physical media ownership rights an interesting topic. Like I said above, this topic really deserves it's own thread. Good information like this gets lost when buried under a nonrelated thread title. In fact, a dedicated thread on this subject will likely garner far more interest and attention than existing as a hi-jacked topic lost in a component review.
Why not copy your post #152 and use it to start a thread on this topic?

Regardless....I don't want to turn AA into a legal forum. I have to deal with legal issues and lawyers everyday. I don't want to do it here. I much prefer to discuss amps, speakers, room acoustics and way more interesting things. So....back to more important things. |

I moved this interesting topic to it's own thread so it can continue, or not.
